User Agreement (Terms of Service) β€” English

USER AGREEMENT / TERMS OF SERVICE

Last updated: 07/10/2026 Developer: Fatih AcΔ± Contact: fatihaci79@gmail.com

Language. The Turkish version of this Agreement is legally binding for Turkish users; this English version is provided for international users. In the event of any discrepancy between the two, the Turkish text prevails for users in Turkey.

By using the maShop application ("the App") you are deemed to have accepted the following terms.

Article 1 β€” Service Definition

maShop is a mobile application developed to enable small business owners and individual sellers to quickly keep records of their sales, purchases and expenses. The App is not an accounting software, a chartered accountancy service, or an official record system.

Article 2 β€” Subscription and Payment

2.1 Changes to Fees. maShop may change subscription fees for future periods. A fee change is effective only prospectively; it does not affect the subscription period you are currently in and for which payment has already been collected.

Any change is announced at least 30 days before it takes effect, by in-app notification and β€” if an email address is registered on your account β€” by email.

As your subscription is billed through Google Play or the App Store, your approval is required through that store's own consent flow before an increased fee can be applied to your subscription. If you do not approve, your subscription simply ends without renewing at the end of the current period; the service continues unchanged throughout that period and no additional charge is applied to you.

If you do not wish to accept the new fee, you may cancel your subscription from your Google Play / App Store account settings without giving any reason and without paying any penalty.

Article 3 β€” User Data and Privacy

For our privacy practices please review the Privacy Policy.

3.1 Backup and Multi-Device Behaviour. User data is primarily stored on the device (local SQLite); server-side backup and cross-device synchronisation vary by your plan:

3.2 Retention of Deleted Records (Tombstone). When a record is deleted, the record is kept on the server marked as "deleted" for 30 days to ensure deletion information reaches other devices. At the end of 30 days it is permanently deleted. This period is a technical necessity and is deemed under KVKK to constitute the end of processing; the record is not displayed and is not included in reports.

3.3 Account Deletion and Retention β€” KVKK Article 11. Your account and data are permanently deleted in two cases:

In both cases maShop does not continue to store this data on the user's behalf; there is no retention such as 10 years for commercial records. Your own retention obligations arising from tax and commercial legislation (including Article 82 of the Turkish Commercial Code) are yours; therefore, before deletion, you are advised to take a copy of your records via Settings β†’ Download My Data. Deletion is irreversible. Only the deletion proof record that demonstrates the deletion remains (its content and 10-year retention period: KVKK Personal Data Notice, Section 5).

3.4 Use of Anonymised Data. In order to improve the service and to offer sector benchmarking features, maShop may make use of anonymised and aggregated data that cannot be associated with any identified or identifiable person. Your raw transaction records fall outside this scope; they are not used for any purpose, including model training, without anonymisation, and are not shared with third parties. For details see Section 2.1 of the KVKK Personal Data Notice.

3.5 Turning Server Backup Off. Server backup is on by default. A Primary Account Holder who uses the account alone on a single device may turn it off under Settings β†’ Backup. While backup is off, transaction data is not sent to the server and is held only on the device; if the device is lost or damaged, the app is uninstalled, or the session is signed out, this data cannot be recovered and does not transfer to a new device. The existing copy on the server is permanently deleted 30 days after the date backup was turned off; it is not deleted if backup is turned back on within that period. Server backup must be on in order to invite an employee/partner or to use a second device. You may export a file copy of your data at any time via Settings β†’ Download My Data. For details see Sections 5 and 6 of the KVKK Personal Data Notice.

Article 4 β€” User Obligations

The user agrees:

Article 5 β€” Disclaimer (APPROXIMATE CALCULATIONS)

All financial calculations displayed in the maShop application β€” profit/loss, cost, total amount, average price and similar values β€” are approximate and for informational purposes and do not constitute:

The user agrees not to rely on app data as the sole basis for official tax returns, accounting records, bank applications or legal proceedings.

The developer cannot be held liable for calculation errors, data loss, or direct or indirect damages arising from the use of the App.

Article 6 β€” Modification or Termination of the Service

The developer reserves the right to change the features of the App or terminate the service, provided that prior notice is given. If the service is terminated during an active subscription period, a refund is made for the remaining period.

Article 6.1 β€” Changes to This Agreement

maShop may update this Agreement due to changes in legislation, new features or changes in how the service operates. The current text is kept accessible at all times in the app under Settings β†’ Privacy & Legal, and the "Last updated" date at the top of the text is changed.

Material changes (the basis of pricing, limits of liability, the scope of data processing and termination conditions) are announced by in-app notification at least 30 days before they take effect. You retain the right to cancel your subscription within that period; if you do not cancel and continue to use the App, this is deemed acceptance of the updated text.

For changes relating to the processing of personal data, the KVKK Personal Data Notice is also updated and, where the scope of processing expands, your explicit consent is obtained again.

Article 7 β€” Governing Law

This agreement is governed by the laws of the Republic of Turkey. The courts of Marmaris (Muğla, Turkey) shall have jurisdiction over any dispute.

Article 8 β€” Multi-User and Authority Balance

8.1 Primary Account Holder. The user who first opens the account and pays the subscription fee is defined as the Primary Account Holder. Deletion of the account, cancellation of the subscription, account transfer (to be implemented in future) and removal of invited users may be carried out only by the Primary Account Holder.

8.2 Invited Users. The Primary Account Holder may invite additional users (Partner or Employee) to their account. Acceptance of the invitation expresses the invited user's express consent to this Agreement and to the KVKK Notice.

8.3 Asymmetric Authority. A user in the Partner role has data access equivalent to that of the Primary Account Holder but does not have account management authority. The Primary Account Holder may individually restrict the permissions granted to a partner (viewing analytics, deep analytics, personnel page, cash movement deletion).

8.4 Account Deletion Flow. An account deletion request by the Primary Account Holder starts a 30-day grace period. During this period the account is in soft delete; when the period expires all account data is permanently deleted. In addition, if no active user of the account signs in for 365 days, the account is permanently deleted due to inactivity, subject to the notification, waiting period and subscription exemption in clause 3.3(b). An in-app push notification is sent to partners and employees; they have no active right of objection. Any dispute over data loss is between the Primary Account Holder and the partner/employee; maShop is not a party to such disputes.

8.5 Disputes and Wind-Up. In the event of a commercial partnership or personal dispute between a Partner and the Primary Account Holder, maShop remains neutral and does not provide any direction in favour of any party on the account. Management of data/financial matters of the account is resolved by an agreement (if any) between the parties themselves or by a court decision.

8.6 Data Subject Rights (KVKK Art. 11). A user's request to have their own personal data deleted is honoured independently of any objection by the other users of the account. When the Primary Account Holder deletes the account, all account data including commercial records is permanently deleted at the end of the grace period; maShop does not continue to store this data on the user's behalf. Retention obligations arising from tax/commercial legislation belong to the user, and an export option is provided before deletion. With respect to third-party personal data (customers, suppliers, personnel) that the user enters into the app, maShop acts as a data processor and the user as the data controller; the obligations to provide a privacy notice and a lawful basis for such data belong to the user (see the KVKK Personal Data Notice). The instructions and terms for this processing are set out in this Agreement and the KVKK Notice; as a data processor, maShop takes the necessary technical and administrative measures under Article 12 of KVKK.

8.7 Ownership Transfer (feature postponed to future versions). Transfer of the Primary Account Holder role to another user (due to death, retirement or personal preference) is not possible in-app in this version; it will be added in subsequent versions through a "heir appointment" mechanism. Until then, in the event of loss of access by the account holder, the user must contact maShop support directly.

8.8 Neutrality of the Service Provider. maShop does not mediate in disputes between users within an account. Decisions taken by the Primary Account Holder are deemed binding by maShop.
